DEFAULTS AND REMEDIES

GENERAL TERMS AND CONDITIONS


    
        7.29.4. Other Remedies – Any termination of an FT or IT Agreement 
                pursuant to the provisions of this section is without prejudice 
                to the right of either Transporter or Shipper to collect any 
                amounts then due to it, and to offset amounts owed to it by 
                the other party from such amounts due to the other party, and 
                is without prejudice to or waiver of, any remedy to which the 
                party not in default may be entitled as a result of the 
                defaulting party's default, breach, or violation of the 
                terms of the terminated FT or IT Agreement.
    
        7.29.5. No waiver by either Transporter or Shipper of any one or 
                more defaults by the other in the performance of any provisions 
                of the FT or IT Agreement shall operate or be construed as a 
                waiver of any future default or defaults, whether of a like 
                or of a different character.
